These Terms of Service (“Terms”) govern access to familiarroutes.org and the purchase or use of advertising services provided by Familiar Routes LLC (“Familiar Routes,” “we,” “us,” or “our”).
By using our website, purchasing services, or otherwise agreeing to these Terms, you agree to be bound by them.
Advertisers may also be required to enter into a separate Advertising Services Agreement and/or Campaign Order with Familiar Routes. If a specific signed agreement conflicts with these general Terms regarding a particular campaign, the signed agreement will control to the extent of that conflict.
1. Familiar Routes Services
Familiar Routes provides shared direct-mail advertising services designed to connect participating businesses with households in selected local markets.
Campaigns may include advertising design and coordination, placement on a shared mailer, QR-code integration, printing and mailing coordination, and related services.
Printing, mailing, payment processing, website services, and other functions may be performed using independent third-party providers.
2. Campaign Distribution
Unless otherwise expressly stated in writing for a particular campaign, Familiar Routes campaigns are designed to reach approximately 10,000 households within selected delivery areas.
References to household counts represent campaign distribution targets or estimates and should not be interpreted as a guarantee that every individual household will physically receive, retain, read, view, or interact with a mail piece.
Delivery may be affected by mailing lists, postal operations, address conditions, production circumstances, governmental actions, weather, and other circumstances outside Familiar Routes' reasonable control.
3. Advertising Placements
Familiar Routes may offer Standard and Premium advertising placements.
Current advertised pricing may include:
Standard Placement: $849 per campaign
Premium Placement: $1,199 per campaign
Applicable taxes may be added to the advertised price.
Pricing, availability, campaign specifications, and future offerings may change. A change will not retroactively alter a placement that has already been purchased and accepted for a specific campaign unless agreed to by the advertiser.
4. Industry Exclusivity
Familiar Routes generally intends to accept only one participating business within a directly competing industry or category for a particular campaign where industry exclusivity has been offered.
Familiar Routes determines reasonable industry classifications and whether businesses constitute direct competitors for purposes of campaign exclusivity.
Exclusivity applies only according to the scope of the applicable campaign, placement, membership, or written agreement and does not prevent Familiar Routes from providing services to other businesses in different campaigns, territories, or noncompeting categories unless expressly agreed otherwise in writing.
5. Payments and Taxes
Advertisers must pay all charges associated with their selected services according to the payment terms presented at purchase or contained in their applicable agreement.
Payments may be processed through third-party payment processors such as Stripe.
Advertisers are responsible for applicable sales, use, or similar taxes charged in connection with the transaction, except for taxes imposed directly on Familiar Routes' income.
Failure or reversal of payment may result in suspension or cancellation of a placement.
## 6. Cancellation and Refund Policy
A paid campaign or placement may be canceled within **48 hours after payment** for a full refund.
After the 48-hour cancellation period expires, campaign payments are generally non-refundable because Familiar Routes may begin reserving placement capacity, planning the campaign, preparing advertising materials, coordinating production, and incurring costs.
If Familiar Routes is unable to fulfill a paid campaign, Familiar Routes may provide an appropriate refund, credit, rescheduling option, or other remedy as required by the applicable agreement or law.
To request a cancellation, contact Familiar Routes promptly at Contact@familiarroutes.org
Nothing in this section limits any rights or remedies that cannot legally be waived.
7. Advertising Materials
Advertisers are responsible for providing accurate information and any materials reasonably necessary to prepare their advertisements.
These materials may include business names, logos, photographs, trademarks, promotional offers, telephone numbers, URLs, pricing information, disclaimers, and other advertising content.
The advertiser represents that it owns or has obtained the permissions necessary for Familiar Routes to reproduce and use advertiser-supplied materials for the requested campaign.
8. Final Approval
Advertisers may be asked to review and approve advertising proofs before production.
The advertiser is responsible for carefully reviewing names, telephone numbers, addresses, websites, QR-code destinations, spelling, prices, offers, expiration dates, disclaimers, and other information.
Once an advertiser gives final approval, Familiar Routes may rely on that approval in proceeding with production.
Changes requested after final approval may not be possible and may result in additional costs or production delays.
9. Advertising Claims and Legal Compliance
Advertisers are responsible for ensuring that the advertising content, claims, promotions, pricing, offers, disclosures, and materials they provide are truthful and lawful.
Familiar Routes may reject or require modification of content that we reasonably believe is unlawful, misleading, infringing, offensive, unsafe, or otherwise inappropriate for a Familiar Routes campaign.
Acceptance of advertising content does not constitute legal approval of that content.
10. Intellectual Property
Familiar Routes and its licensors retain ownership of the Familiar Routes website, branding, original materials, designs, systems, and other intellectual property owned by Familiar Routes.
Advertisers retain their rights in their preexisting trademarks, logos, photographs, and other advertiser-owned materials.
Advertisers grant Familiar Routes a limited license to reproduce, modify as reasonably necessary for production, display, print, and distribute advertiser-provided materials for purposes of providing the purchased advertising services.
## 11. QR Codes and Third-Party Destinations
Advertising placements may include QR codes directing recipients to an advertiser-selected website, offer, booking page, menu, or other digital destination.
Advertisers are responsible for ensuring their destination remains operational, appropriate, secure, and accurate.
Familiar Routes does not guarantee any particular number of QR-code scans, website visits, inquiries, appointments, leads, or sales.
12. No Guarantee of Advertising Results
Advertising results vary substantially.
Familiar Routes does not guarantee any specific level of consumer response, leads, calls, website traffic, QR-code scans, appointments, sales, revenue, profit, brand awareness, or return on investment.
Payment is for the advertising services and campaign participation described in the applicable order or agreement, not for a guaranteed business result.
13. Third-Party Providers
Familiar Routes may use third-party companies for printing, mailing, payment processing, website hosting, software, communications, and other operational services.
Although Familiar Routes will use reasonable efforts to coordinate the services for which it is responsible, certain third-party systems and activities are outside our direct control.
14. Website Use
You may use familiarroutes.org only for lawful purposes.
You may not intentionally interfere with the website, attempt unauthorized access to systems or information, introduce malicious software, impersonate another person or business, use the website to commit fraud, or otherwise misuse the website or its services.
15. Disclaimer
To the extent permitted by applicable law, Familiar Routes provides its website and services subject to the terms, limitations, and specifications communicated in the applicable campaign materials and agreements.
Familiar Routes does not represent that the website will operate without interruption or that advertising will produce any particular commercial outcome.
Nothing in these Terms excludes warranties or obligations that cannot lawfully be excluded.
16. Limitation of Liability
To the maximum extent permitted by applicable law, Familiar Routes will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the website or advertising services, including lost profits, lost business opportunities, or anticipated advertising results.
To the maximum extent permitted by applicable law, Familiar Routes' aggregate liability arising from a particular paid campaign will not exceed the amount paid to Familiar Routes for the affected campaign.
These limitations do not apply to liability that cannot legally be limited or excluded.
17. Indemnification
To the extent permitted by applicable law, an advertiser agrees to indemnify and hold Familiar Routes harmless from third-party claims, damages, liabilities, and reasonable costs arising from advertiser-provided content, infringement caused by materials supplied by the advertiser, unlawful or misleading advertiser claims, or the advertiser's material violation of these Terms or its applicable Advertising Services Agreement.
The scope and enforceability of this provision remain subject to applicable law and any controlling signed agreement.
18. Force Majeure and Delays
Familiar Routes will not be responsible for delays or failures caused by circumstances beyond its reasonable control, which may include severe weather, natural disasters, postal disruptions, governmental actions, labor disruptions, widespread technology failures, vendor disruptions, or other comparable events.
Where appropriate, Familiar Routes may attempt to reschedule, modify, credit, or otherwise reasonably address an affected campaign.
19. Electronic Communications
You consent to conducting transactions and receiving agreements, approvals, notices, receipts, and other communications electronically where permitted by law.
Electronic approval of artwork, campaign information, agreements, and related records may be retained as part of Familiar Routes' business records.
20. Privacy
Use of the Familiar Routes website is also subject to our Privacy Policy.
Third-party services, including payment processors and advertiser-linked destinations, may maintain separate privacy policies and terms.
21. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Before initiating formal proceedings, the parties are encouraged to make reasonable good-faith efforts to resolve disputes directly.
22. Changes to These Terms
Familiar Routes may update these Terms periodically.
The “Last Updated” date identifies the most recent revision.
Changes will apply prospectively unless otherwise permitted by law. Terms applicable to a completed purchase will remain subject to any controlling agreement entered into for that transaction.
23. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
24. Entire Terms
These Terms, together with the Privacy Policy and any applicable Campaign Order or Advertising Services Agreement, constitute the relevant agreement between you and Familiar Routes concerning the matters they cover.
A separately signed agreement controls where it expressly establishes different terms for a particular transaction.
